Toll Violation Notice Facts
All drivers on the Illinois Tollway System are required to pay the proper toll. Failure to do so can result in the issuance of a toll violation notice requiring the owner of the vehicle to pay a fine as well as the missed toll. The Tollway only issues notices to repeat offenders. The license plate is then sent to the Illinois Secretary of State database, or appropriate out-of-state department of motor vehicles, for identification of the registered owner.
In January 2003, the Illinois Tollway implemented an enhanced Violation Enforcement System to crack down on toll scofflaws on behalf of the 97 percent of Tollway customers who abide by the law and pay their fair share. Anyone who uses the Tollway must pay the tolls or face the consequences as indicated by signs at all toll plazas.
Sections 2520.2269(e) and 2520.750 of the Illinois Administrative Code authorizes The Illinois Tollway to assess a mandatory $20.00 fine per violation against the registered owner of a vehicle for failure to pay the proper toll.
Toll violation notices will include a photo of one of the violation events that the Illinois Tollway has on record, as well as details of the date, time and location of each violation event.
Respond to notices in a timely manner
Individuals receiving a Violation Notice have 21 days from the issue date of the Violation Notice to either pay the full amount due or schedule a hearing to dispute the violation.
Failure to respond to this Notice by either paying the total amount due within 21 days of this Notice or requesting a hearing to contest the violations within 21 days of this Notice shall be deemed as an admission of liability and a waiver of your right to a hearing and shall result in a Hearing Officer's Final Order for the total amount due being issued against you by default.
Failure to satisfy any fines or penalties within 14 days after the entry of a Hearing Officer's Final Order, resulting by default or by contest, shall result in an additional fine of $50 per liable violation
being assessed. Also at this time, if five (5) or more violations are outstanding and past due, a notice of impending suspension is issued .
Failure to satisfy any fines or penalties after the entry of an Impending Suspension Notice shall result in the Tollway forwarding the matter to the Secretary of State for suspension of the driving privileges, vehicle registration, or both, and other sanctions provided by law.
