Insurance Claim Questions

The Tollway has established a process for claims of property damage to a vehicle directly related to system operations. The Tollway cannot accept responsibility for incidents for which direct liability is not clear, or for circumstances outside the control of the Tollway. These incidents include, but are not limited to:

  • Weather related events and conditions
  • Damage caused by other motorists
  • Unreported road conditions or debris

If your damage requires urgent attention, may we suggest you contact your insurance agent. The insurance company can arrange for repairs and present a claim to the Tollway on your behalf, including your deductible.

Download a claim form or call the Risk Management Division at (630) 241-6800, ext. ext. 4288 — to have a form promptly mailed.

If leaving a voice-mail message, please speak slowly and include:

  • Name
  • Address
  • Date of incident
  • Brief description of incident

In addition to completing the Claim Form, you are responsible for:

  • Submitting two repair estimates (or paid receipts if the damages have been repaired)
  • Photographs depicting the damages (preferred, but optional),
  • Proof of Ownership (copy of title/registration or insurance card) as well as an
  • Incident Report or Accident Report prepared by the Illinois State Police (required).

All claims are considered on an individual basis. The adjuster completes a thorough investigation based on all available information. You may be contacted for additional information or clarification. After a determination has been made regarding your claim, you will be advised in writing of the Tollway’s decision. While every effort is made to expedite the investigation, please allow approximately 15 - 30 days for your claim to be processed. Claims are not be processed without an Incident or Accident Report from the Illinois State Police. Learn more about an Incident or Accident Report.

The Tollway is a user-fee system, and receives no tax dollars for maintenance and operation. When damage is done to items such as light poles, guardrails, and other property owned by the Tollway, the Tollway looks to the party responsible for the damages for reimbursement. It is only fair that all users of the Tollway not be penalized by having their tolls applied to pay for these damages.

In most cases your Automobile Insurance will cover payment for damage to property. Any billing received from the Tollway should be forwarded to your insurance carrier with instructions to contact the Tollway. If you were not covered by insurance, you are expected to reimburse the Tollway in full.

Payment can be made in the form of personal check, money order, or credit card. Note the Invoice Number on all payments to ensure proper credit. If you elect to pay by credit card, a form is included with the billing for such purposes. No payments will be accepted over the telephone. In certain circumstances, if you cannot afford to make payment in full, a brief payment plan may be offered. This is determined on an individual basis, and a representative of the Tollway’s Risk Management Division will be happy to discuss this payment option.

If you are liable for damages to the Tollway, and do not arrange for this obligation to be satisfied, your name will be sent to the Illinois Secretary of State. In due course your vehicle licensing privileges, as well as your driving privileges will be suspended, and not reinstated until such time as the obligation has been satisfied. Your damage claim may also be forwarded to a collection agency for further collection efforts which may ultimately lead to legal action.

As a result, the Tollway looks to the party benefiting from these services for reimbursement.
