Commercial Vehicle Violation Information

If you received a Notice of Toll Violation from the Illinois Tollway, you are eligible to pay only the tolls if you meet the following requirements:

  • I-PASS/E-ZPass account must have been opened prior to the time of the violation.
  • Account information and toll payments are received within the timeframe allowed.

Keep in mind, additional fines will be assessed if toll payments are received after the due date of the Notice of Impending Suspension.

PrePass Plus Customers with Violations

  • Fines will be dismissed after receipt of the appropriate payment and account information.
  • If toll payments are received after the due date of the Notice of Impending Suspension, additional fines will be assessed.

E-ZPass Customers with Violations

  • Fines will be dismissed after receipt of the appropriate payment and account information.
  • Customers must submit a copy of their E-ZPass account report which identifies the account number, account open date, account status (active/inactive-open/closed) and that the license plate in question is registered to the account.

Reassignment of Illinois Tollway Violations

If a leasing or rental agency intends to reassign violations to the person who was driving when the violation occurred, the agency must be the registered owner of the vehicle.

In order to ensure compliance with Section 10(a-5) of the Toll Highway Act, 605 ILCS 10/10 (a-5), the Tollway will reassign violations:

  1. For commercial entities in the business of renting and/or leasing vehicles, which the commercial entity owns, to other parties.
  2. If the rental/leasing agreement(s) for your company contain a provision advising the customer that they will be responsible, for payment to the issuing agency, for tolls and fines.

605 ILCS 10/10 (a-5) No commercial entity that is the lessor of a vehicle under a written lease agreement shall be liable for an administrative notice of violation for toll evasion issued under this subsection (a-5) involving that vehicle during the period of the lease if the lessor provides a copy of the leasing agreement to the Tollway within 21 days of the issue date on the Notice of Toll Violation.

The leasing agreement also must contain a provision or addendum informing the lessee that the lessee is liable for payment of all tolls and any fines for toll evasion. Each entity must also post a sign at the leasing counter notifying the lessee of that liability.

The copy of the leasing agreement provided to the Tollway must contain the name, address, and driver's license number of the lessee, as well as the check-out and return dates and times, the vehicle license plate number, make and model. The statute covers any type of vehicle leasing company truck or car rental.
